Version 1.0 — 2026-08-28. Effective upon publication in the Service.
Final review note (for the acting DPO before go-live): all business-identity fields are completed. Two items to confirm before publishing — (a) the named AI sub-processors below and each provider's input-training terms; (b) the liability-cap figure in the Terms.
Use HOS lawfully and responsibly. Do not use it for anything illegal, abusive, or harmful — and above all, never for any child sexual content, which we prohibit with zero tolerance and report to authorities. Do not attack the Service, break its security or the separation between users, reverse-engineer it, spam, scrape, or infringe others' rights. Do not rely on it for high-risk decisions. If you see abuse, report it to us. We may remove content, suspend or permanently ban accounts, and report unlawful activity to the authorities. This summary does not override the numbered sections below.
1.1. This Acceptable Use Policy (the "AUP") governs your use of "HOS", the AI personal-assistant web application provided by EUMENES.AI (the "Operator", "we", "us", "our") under the Eumenes brand (the "Service").
1.2. This AUP is incorporated into and forms part of our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service. Violating this AUP is a violation of the Terms of Service.
1.3. You are responsible for your own use of the Service and for anyone using the Service through your account. This AUP applies to all content you submit, generate, connect, transmit, or receive through the Service ("Content").
You must not use the Service, and must not permit or encourage anyone else to use the Service, to do any of the following.
2.1. Illegal content or activity. Engage in, facilitate, or promote any activity that is unlawful under any applicable law, or that produces, stores, distributes, or accesses illegal content.
2.2. Child sexual abuse material and child sexual content — ZERO TOLERANCE. Create, upload, request, generate, store, solicit, distribute, or access any child sexual abuse material ("CSAM") or any content that sexualises, exploits, or endangers minors, including sexualised depictions (real, synthetic, AI-generated, cartoon, or otherwise) of any person under 18. This is strictly prohibited. We will remove such content, terminate the account immediately, preserve relevant records, and report to law-enforcement and competent authorities (including relevant child-safety hotlines/agencies) as required or permitted by law.
2.3. Harassment, threats, and abuse. Harass, bully, stalk, threaten, intimidate, or defame any person; incite or promote violence, self-harm, or suicide; or target any person or group with abusive conduct.
2.4. Hateful content. Create or disseminate content that promotes or incites hatred, discrimination, or violence against individuals or groups based on race, ethnicity, national origin, religion, caste, sex, gender, gender identity, sexual orientation, disability, age, or other protected characteristic.
2.5. Spam and bulk messaging. Send spam, chain messages, or unsolicited bulk or commercial communications; conduct phishing or other deceptive messaging; or use the Service (including any Connected email or messaging account) to distribute unsolicited or automated bulk messages.
2.6. Malware and hacking. Upload, generate, or transmit viruses, worms, ransomware, spyware, or other malicious code; develop, distribute, or facilitate hacking, credential theft, denial-of-service attacks, or other malicious cyber activity.
2.7. Security, tenant isolation, and reverse engineering. Attempt to gain unauthorised access to the Service, its systems, other users' accounts, data, or content, or to any infrastructure; probe, scan, or test the vulnerability of the Service without authorisation; defeat, circumvent, or interfere with authentication, rate limits, quotas, or the isolation between users/tenants; or decompile, disassemble, reverse-engineer, or otherwise attempt to derive source code, models, or underlying components, except to the limited extent such restriction is prohibited by law.
2.8. Intellectual-property and privacy infringement. Infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, moral, privacy, publicity, or other right of any person; upload content you do not have the right to use; or introduce third-party personal data into the Service without a lawful basis and any required consent.
2.9. Abusive or harmful AI-generated content. Use the Service to generate content that is deceptive, fraudulent, defamatory, or designed to harm, including disinformation campaigns, impersonation, non-consensual intimate imagery, deepfakes intended to deceive or harm, instructions for weapons or violence, or content that facilitates serious harm.
2.10. Scraping and unauthorised automation. Scrape, harvest, crawl, or extract data from the Service through automated means except as we expressly permit; use bots or automation to overload or abuse the Service; or use the Service to scrape or extract data from third parties in violation of their terms or applicable law.
2.11. Reselling, reidentification, and misuse of data. Resell, sublicense, or commercially exploit the Service without authorisation; attempt to re-identify anonymised or aggregated data; or use the Service to profile, surveil, or track individuals unlawfully.
2.12. High-risk uses. Use the Service, or rely on its outputs, for high-risk purposes where errors could lead to death, personal injury, or serious physical, financial, legal, or environmental harm — including medical diagnosis or treatment, legal advice, financial or investment decisions, safety-critical systems, emergency services, the operation of dangerous machinery, or other critical decision-making — without independent professional verification and appropriate human oversight. AI outputs are not professional advice (see the Terms of Service).
2.13. Circumvention and facilitation. Attempt to circumvent any restriction in this AUP, or assist, encourage, or enable any third party to do any of the above.
3.1. You are responsible for ensuring that your Content and your use of the Service comply with this AUP, the Terms of Service, and all applicable laws, and that you have all rights and consents necessary for the Content and Connected Services you use.
3.2. You must promptly remove or cease any Content or use that violates this AUP upon becoming aware of it, and cooperate with any reasonable request from us relating to a suspected violation.
4.1. If you become aware of any Content or activity on the Service that violates this AUP — including illegal content, CSAM, harassment, or intellectual-property infringement — please report it to us at support@eumenes.ai (subject line "ABUSE REPORT" or "IP NOTICE" as appropriate).
4.2. To help us act quickly, please include, where possible: (a) a description of the Content or activity and why it violates this AUP or the law; (b) enough information to locate it; (c) your contact details; and (d) for intellectual-property complaints, identification of the right and a statement of your good-faith belief and authority. Please do not attach or transmit any illegal content itself; instead describe it.
4.3. Reports are routed to a moderation queue for review. We aim to review reports promptly and, where we determine a violation has occurred, to take appropriate action, which may include removing or disabling access to the Content, restricting features, suspending or terminating accounts, and, where legally required or appropriate, reporting to authorities and preserving evidence.
4.4. We may, at our discretion and to the extent permitted by law, keep a reporter informed of the outcome, and we may decline to act on reports that are unfounded, abusive, or made in bad faith.
5.1. We may investigate suspected violations of this AUP. Consistent with our "zero standing access" policy in the Privacy Policy, our review is limited to what is necessary and lawful to detect, prevent, and address violations, security incidents, and unlawful content.
5.2. Where we determine, in our reasonable discretion, that a violation has occurred or to protect the Service, users, third parties, or us, we may take any one or more of the following actions, with or without prior notice and to the maximum extent permitted by applicable law: - remove, disable, or restrict access to Content; - issue a warning; - limit, suspend, or permanently ban your account and access to the Service; - preserve and disclose records; and - report the matter to law-enforcement, regulators, or other competent authorities where legally required or appropriate, and cooperate with any lawful investigation.
5.3. For serious violations — including CSAM, credible threats of violence, or serious unlawful activity — we may act immediately, including permanent termination and reporting to authorities, without prior notice.
5.4. We are not liable for any action taken in good faith to enforce this AUP, and enforcement action does not limit any other remedy available to us under the Terms of Service or at law.
6.1. We may update this AUP from time to time; changes take effect when the updated AUP is posted, and your continued use constitutes acceptance. We will update the "Dated" line above when we make changes.
6.2. This AUP is not exhaustive. We reserve all rights, including the right to determine, in our reasonable discretion, whether any use violates this AUP, and to take action to protect the Service, its users, and third parties, even where a specific use is not expressly listed above.
End of Acceptable Use Policy (v1.0, 2026-08-28).
